Each party bears the cost of internet data and software/subscriptions incurred when needed to facilitate online tutoring. Because the student is a minor, the model provides that the agreement is reached between the tutor and the student`s parent/guardian and not with the student. The proposal also contains a number of other provisions that are necessary or proportionate when the student is a minor. This agreement should only be used if the person receiving or receiving study sessions is a “consumer” within the meaning of the Consumer Rights Act 2015 (i.e., a person who solicits or receives services or uses facilities for personal use and for purposes entirely or primarily outside the purpose of a transaction by that person or another person). This document is appropriate for use where the contract is a “suburban,” “off-premise” or “distance” contract within the meaning of the 2013 consumer contracts (information, cancellation and additional charges). The easing, leniency, waiver or release of any of the rights within the meaning of this agreement by a party on one occasion prevents the subsequent application of those rights and is not considered a waiver of a subsequent violation of any of the conditions.
